Iowa Code 124.401 makes it unlawful to manufacture, deliver, or possess with intent to manufacture or deliver a controlled substance. Penalties scale significantly based on the type and quantity of the substance involved:

• Class B felony: Up to 50 years in prison and a fine of up to $1,000,000, reserved for the largest quantities of methamphetamine, cocaine, heroin, or LSD
• Class C felony: Up to 10 years in prison and a fine between $1,000 and $50,000, applied to lower-quantity manufacturing or possession with intent to manufacture
• Aggravated misdemeanor: Charged when the alleged intent to manufacture involves a Schedule IV or V controlled substance, which includes many prescription medications

Enhanced Penalties That Can Increase Your Exposure

Several provisions of Iowa law can push a manufacturing sentence well beyond the base felony range, and understanding them matters from the first day of your defense.

• Precursor chemical possession: Possessing ephedrine, pseudoephedrine, anhydrous ammonia, or red phosphorus with intent to manufacture is a Class D felony under Iowa Code 124.401(4)
• Proximity to protected locations: Iowa Code 124.401A allows an additional term of up to five years when manufacturing with intent to distribute occurs within 1,000 feet of a school, public park, swimming pool, or recreation center
• Manufacturing near a minor: Under Iowa Code 124.401C, anyone 18 or older who manufactures in the presence of a minor faces double the sentence otherwise imposed, and that portion can’t be deferred or suspended
• Drug court eligibility: Iowa Code 124.401E allows a court to suspend the sentence for a first methamphetamine or amphetamine manufacturing or delivery conviction and order a drug court program instead
