Iowa Code 124.401 makes it unlawful to manufacture, deliver, or possess with intent to manufacture or deliver a controlled substance. Penalties scale significantly based on the type and quantity of the substance involved:

  • Class B felony: Up to 50 years in prison and a fine of up to $1,000,000, reserved for the largest quantities of methamphetamine, cocaine, heroin, or LSD
  • Class C felony: Up to 10 years in prison and a fine between $1,000 and $50,000, applied to lower-quantity manufacturing or possession with intent to manufacture
  • Aggravated misdemeanor: Charged when the alleged intent to manufacture involves a Schedule IV or V controlled substance, which includes many prescription medications

  • Drug court eligibility: Iowa Code 124.401E allows a court to suspend the sentence for a first methamphetamine or amphetamine manufacturing or delivery conviction and order a drug court program instead
